Membership Terms and Conditions
Annual Contract Membership Agreement
These Membership Terms and Conditions (“Agreement”) govern all annual contract membership plans offered by VirtuMotorsport, LLC (“VirtuMotorsport,” “Company,” “we,” “us,” or “our”). By enrolling in a Casual, Pro, or Elite Annual Membership (“Membership”), the individual (“Member,” “you,” or “your”) agrees to be bound by this Agreement.
1. Annual Membership Term
1.1 Annual Memberships are issued for a fixed term of twelve (12) consecutive months beginning
on the Membership start date.
1.2 The Member agrees to remain enrolled and financially responsible for the entire 12-month
term.
1.3 No initiation fee is required for Annual Memberships.
2. Payment Terms
2.1 Annual Membership fees may be paid monthly in equal installments or in full upfront.
2.2 Monthly installment payments are billed automatically to the payment method on file.
2.3 Failure to maintain a valid payment method does not relieve financial responsibility.
3. Non-Payment & Late Fees
3.1 If a scheduled payment is declined or not received, the account will be considered delinquent.
3.2 A late fee of $15 may be assessed for each failed or missed payment.
3.3 Membership access may be suspended until the balance is brought current.
3.4 Continued non-payment may result in account termination and collection efforts.
4. Early Cancellation & Liquidated Damages
4.1 Early cancellation of an Annual Membership is not permitted without penalty.
4.2 If the Member cancels, defaults, or is terminated before completion of the 12-month term, the
Member agrees to pay liquidated damages equal to 50% of the remaining unpaid Membership
balance, or two (2) months of fees, whichever is greater.
4.3 Liquidated damages represent a reasonable estimate of losses and are not a penalty.
4.4 Any outstanding balance becomes immediately due upon early termination.
5. Sessions & Monthly Usage
5.1 Casual and Pro Annual Memberships include a fixed number of monthly sessions.
5.2 Elite Annual Memberships include unlimited session days per month, subject to availability and
reservations.
5.3 Unused sessions do not carry over.
5.4 Membership usage is non-transferable except as expressly permitted under the Buddy Pass
policy.
6. Session Duration & Extended Time
6.1 Casual and Pro sessions are up to one (1) hour.
6.2 Sessions may extend up to two (2) hours if availability allows.
6.3 Extended time is not guaranteed.
6.4 Elite Memberships include guaranteed two-hour sessions when booked accordingly.
7. Reservations & Walk-In Policy
7.1 Walk-in sessions are not guaranteed.
7.2 Members are encouraged to reserve sessions in advance.
7.3 Access may be denied due to capacity limits, scheduling conflicts, or operational needs.
8. Reservation System Enforcement
8.1 All sessions must be booked, modified, and canceled through VirtuMotorsport’s official
reservation system.
8.2 Failure to book the correct session length may result in session limitation or early termination.
8.3 Abuse of booking privileges may result in suspension or termination.
9. No-Show & Attendance Policy
9.1 No-shows are failure to attend a reserved session or fixed race entry without proper
cancellation.
9.2 No-shows result in forfeiture of the session with no refund or credit.
9.3 Repeated no-shows may result in booking restrictions.
10. Fixed Race Entries
10.1. Fixed Race Entries allow Members to compete over an extended period of time within VirtuMotorsport’s championship system.
10.2. Points are awarded for each fixed race in which the Member participates, and accumulated points determine championship standings.
10.3. Participation in Fixed Race Entries makes the Member eligible for end-of-season or final championship rewards, subject to VirtuMotorsport’s published rules and availability.
10.4. Memberships may be used to register for Fixed Race Entries, subject to availability.
10.5. Race registrations are limited to the maximum number of sessions available under the Member’s plan for that billing period, except for Elite Memberships, which are not subject to session-count limitations.
10.6. Race entries are non-transferable.
10.7. Elite Membership No-Show Penalty: Elite Members who fail to attend a booked fixed race entry without proper cancellation will be assessed a $5 no-show penalty, charged to the payment method on file.
11. Buddy Pass Policy
11.1 Pro Annual Memberships include one Buddy Pass per month (60 minutes).
11.2 Elite Annual Memberships include two Buddy Passes per month (not simultaneous).
11.3 Buddy Passes do not carry over and expire monthly.
11.4 Member must be present and is responsible for guest conduct.
12. Membership Ownership & Misuse
12.1 Memberships are issued to one individual only.
12.2 Unauthorized use may result in termination without refund.
13. Payment Authorization
By enrolling, the Member authorizes VirtuMotorsport, LLC to charge the payment method provided
for:
1. All recurring annual Membership fees;
2. Any applicable late fees, penalties, or no-show charges;
3. Any balance due from early cancellation or termination for cause.
All charges processed under this authorization are valid, enforceable, and due immediately.
14. Changes to Membership Terms
14.1 VirtuMotorsport may modify these Terms with reasonable notice.
14.2 Changes do not affect the obligation to complete the 12-month term.
15. Termination for Cause
15.1 VirtuMotorsport may suspend or terminate a Membership for violations, misuse, or disruptive
behavior.
15.2 Termination for cause does not relieve financial obligations.
16. Governing Law
16.1 This Agreement is governed by the laws of the state in which VirtuMotorsport, LLC operates.
Acknowledgment
By enrolling in an Annual Casual, Pro, or Elite Membership, the Member acknowledges that they
have read, understood, and agree to this Annual Membership Agreement and its financial
obligations.
