Membership Terms and Conditions
Month-to-Month Membership Agreement
These Membership Terms and Conditions (“Agreement”) govern all month-to-month membership plans offered by VirtuMotorsport, LLC (“VirtuMotorsport,” “Company,” “we,” “us,” or “our”). By enrolling in a Casual, Pro, or Elite Membership (“Membership”), the individual (“Member,” “you,” or “your”) agrees to be bound by this Agreement.
1. Membership Enrollment & Initiation Fee
1.1. All Memberships require payment of a non-refundable initiation fee of $99, due at the time of sign-up.
1.2. The first month’s membership fee is due at sign-up and will be charged together with the initiation fee.
1.3. Memberships are billed on a recurring month-to-month basis unless properly canceled in accordance with this Agreement.
2. Minimum Membership Commitment
2.1. All Casual, Pro, and Elite Memberships require a minimum commitment of sixty (60) days from the Membership start date.
2.2. Cancellation is not permitted during the initial sixty (60) day period for any reason.
3. Cancellation Policy
3.1. After completion of the initial 60-day minimum commitment, Members may cancel their Membership by providing written or verbal notice at least thirty (30) days in advance.
3.2. Verbal cancellation notice is considered effective only when acknowledged by VirtuMotorsport staff and recorded in the Company’s membership system. The date of acknowledgment shall be deemed the official notice date.
3.3. Membership fees will continue to be billed during the 30-day notice period, including the final billing cycle.
3.4. Failure to provide proper notice will result in continued billing until the notice requirement is satisfied.
3.5. All initiation fees and previously paid membership fees are non-refundable.
4. Sessions & Monthly Usage
4.1. Casual and Pro Memberships include a fixed number of sessions per month as defined by the selected plan.
4.2. Elite Memberships include unlimited session days per month, allowing attendance on any day of operation, subject to availability and reservation requirements.
4.3. Unused sessions (where applicable) do not carry over and expire at the end of each billing month.
4.4. Except where explicitly stated under the Buddy Pass policy, Membership usage is non-transferable and limited to the registered Member.
5. Session Duration & Extended Time
5.1. Casual and Pro Memberships include standard sessions of up to one (1) hour.
5.2. Sessions for Casual and Pro Members may be extended to a maximum of two (2) hours only if the time slot immediately following the session remains open after the initial 60 minutes.
5.3. Extended time for Casual and Pro Memberships is not guaranteed and is granted solely at VirtuMotorsport’s discretion based on availability.
5.4. Elite Memberships include guaranteed sessions of up to two (2) hours, provided that the two-hour session is booked accordingly through VirtuMotorsport’s official reservation system.
6. Reservations & Walk-In Policy
6.1. Walk-in sessions are not guaranteed for any Membership tier.
6.2. Members are strongly encouraged to reserve sessions in advance using the official reservation system.
6.3. VirtuMotorsport reserves the right to deny access due to capacity limits, scheduling conflicts, late arrival, or operational needs.
7. Reservation System Enforcement
7.1. All sessions must be booked, modified, and canceled exclusively through VirtuMotorsport’s official reservation system.
7.2. Failure to book the correct session length (including two-hour Elite sessions) may result in session limitation, early termination, or denial of extended time.
7.3. Repeated failure to follow reservation rules, no-shows, or abuse of booking privileges may result in temporary suspension of reservation access or Membership termination, at VirtuMotorsport’s discretion.
8. No-Show & Attendance Policy
8.1. A No-Show is defined as failure to attend a reserved session or fixed race entry without proper cancellation through the reservation system.
8.2. No-shows are not eligible for refunds, credits, or session reinstatement. Any missed session will be deducted from the Member’s plan for that billing period, where applicable.
8.3. Repeated no-shows may result in booking restrictions or further action at VirtuMotorsport’s discretion.
9. Fixed Race Entries
9.1. Fixed Race Entries allow Members to compete over an extended period of time within VirtuMotorsport’s championship system.
9.2. Points are awarded for each fixed race in which the Member participates, and accumulated points determine championship standings.
9.3. Participation in Fixed Race Entries makes the Member eligible for end-of-season or final championship rewards, subject to VirtuMotorsport’s published rules and availability.
9.4. Memberships may be used to register for Fixed Race Entries, subject to availability.
9.5. Race registrations are limited to the maximum number of sessions available under the Member’s plan for that billing period, except for Elite Memberships, which are not subject to session-count limitations.
9.6. Race entries are non-transferable.
9.7. Elite Membership No-Show Penalty: Elite Members who fail to attend a booked fixed race entry without proper cancellation will be assessed a $5 no-show penalty, charged to the payment method on file.
10. Buddy Pass Policy
10.1. Pro Memberships include one (1) Buddy Pass per billing month, allowing one guest to participate for up to sixty (60) minutes.
10.2. Elite Memberships include two (2) Buddy Passes per billing month, which may not be used simultaneously.
10.3. Buddy Pass usage is subject to availability and reservation requirements.
10.4. Buddy Passes do not carry over, have no cash value, and expire at the end of each billing month.
10.5. The Member must be present during Buddy Pass usage and is responsible for their guest’s conduct.
11. Membership Ownership & Misuse
11.1. Memberships are issued to one individual only.
11.2. Sharing, transferring, or allowing unauthorized use of a Membership—outside of the explicitly defined Buddy Pass policy—is strictly prohibited.
11.3. Violations may result in suspension or termination of Membership without refund.
12. Changes to Membership Terms
12.1. VirtuMotorsport, LLC reserves the right to modify these Terms and Conditions at any time.
12.2. Continued use of the Membership after changes are posted constitutes acceptance of the revised terms.
13. Termination for Cause
13.1. VirtuMotorsport may suspend or terminate a Membership without refund for violations of this Agreement, misuse of equipment, disruptive behavior, or failure to comply with company policies.
14. Governing Law
14.1. This Agreement shall be governed by and construed in accordance with the laws of the state in which VirtuMotorsport, LLC operates.
Acknowledgement
By enrolling in a month-to-month Casual, Pro, or Elite Membership, the Member acknowledges that they have read, understood, and agree to these Membership Terms and Conditions.
